Terms of Service

Welcome to Better Painting LLC ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our painting services. By hiring Better Painting LLC, you agree to comply with and be bound by these Terms. Please read them carefully.
1. Services
1.1 Scope of Services
Better Painting LLC offers a variety of painting services, including but not limited to interior and exterior residential and commercial painting. The specifics of the services will be detailed in a written estimate provided prior to the commencement of any work.
1.2 Estimates and Quotes
We offer free estimates for all projects. All estimates provided are valid for 30 days from the date of issuance. We reserve the right to adjust the estimate if the scope of work changes.
2. Payment Terms
2.1 Deposit
A payment is required to schedule the project. For projects estimated over $2,000, a payment of $500 is required. For projects estimated under $2,000, a payment of $200 is required. Customers have 3 days from the time they sign and agree to the contract to cancel and receive their 1st payment back. After 3 days, the 1st payment becomes non-refundable.
2.2 Progress Payments
50% of the total invoice is due on the day we begin the work. The final 50% is due within 24 hours of project completion. Payment methods accepted include cash, check, and major credit cards. Failure to pay the balance within 7 days of project completion will incur a late fee of 1.5% per month.
3. Customer Responsibilities
3.1 Access to Property
Customers must provide access to the property during the agreed-upon working hours. Any delays caused by restricted access may result in additional charges and/or delay in project completion.
3.2 Preparation
Customers are responsible for moving fragile or valuable items out of the work area. Better Painting LLC is not liable for any damage to items left in the work area.
4. Workmanship and Warranty
4.1 Quality of Work
We strive to provide high-quality painting services. If you are not satisfied with our work, please contact us within 30 days of project completion, and we will address your concerns.
4.2 Warranty
The warranty provided is based on the package the customer decides to go with. Please refer to your specific package details for warranty information.
5. Cancellations, Rescheduling, and Penalties
5.1 Cancellations and Rescheduling
Customers may cancel or reschedule their project up to 14 days before the scheduled start date without penalty. Cancellations or rescheduling made less than 14 days before the start date will forfeit the deposit and incur a $500 fee for materials and time.
6. Liability
6.1 Limitation of Liability
Better Painting LLC is not liable for any indirect, incidental, or consequential damages arising from our services. Our total liability is limited to the amount paid for the services rendered.
6.2 Insurance
We carry general liability insurance and workers' compensation insurance to protect both our employees and customers.
7. Dispute Resolution
7.1 Arbitration
Any disputes arising out of or relating to these Terms or our services will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
7.2 Governing Law
These Terms are governed by the laws of the state in which the services are provided, without regard to its conflict of law principles.
8. Miscellaneous
8.1 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
8.2 Entire Agreement
These Terms constitute the entire agreement between Better Painting LLC and the customer regarding our services and supersede all prior agreements and understandings.
